TERMS AND CONDITIONS FOR PARTICIPATING CLUBS

These terms and conditions ("T&Cs") apply in respect of all cricket clubs who apply to be a beneficiary ("Beneficiary/Beneficiaries") of funds raised from the GOOD FOR CRICKET PRIZE DRAW ("Prize Draw"). If a cricket club is ineligible or is otherwise in breach of these T&Cs, that club will not be entitled to receive any funds raised from the Prize Draw.

The Promoter of this Prize Draw is Toyota (GB) PLC ("the Promoter").

1. Eligible Clubs Only

Participation to become a Beneficiary is strictly limited to cricket clubs that are officially affiliated with one of the following governing bodies:

  • The England and Wales Cricket Board (ECB);
  • Cricket Scotland; or
  • Cricket Ireland (Northern Ireland region only),

(separately "Governing Body", together the "Governing Bodies").

2. Club Status Verification

  • All applications on behalf of a registered and affiliated cricket club must be by an authorised representative aged 18 or over. The representative must be a registered official of the club with authority from their club to apply for the club to become a Beneficiary.
  • Clubs may be required to provide their unique identifier number as proof of current affiliation status upon request.
  • Clubs that are not currently affiliated are not eligible to apply to become a Beneficiary

3. Unaffiliated Clubs

  • Cricket clubs that are currently unaffiliated but wish to participate must first apply for official affiliation by contacting their respective Governing Body.
  • Only once official affiliation is confirmed by the club's Governing Body will the club become eligible to register to become a Beneficiary.

4. How to Participate

  • For affiliated cricket clubs to register to become a Beneficiary, their representative must register online https://toyotagoodforcricket.co.uk/ ("Platform").
  • To register online the representative must:
    • register their personal information;
    • register the club by inputting club details; and
    • provide details of a second club committee member.
  • Once the cricket club has been registered to become a Beneficiary, the club can access their dashboard to add the clubs bank details. Please note restrictions around bank details in clause 6 below.
  • It is the responsibility of the club and/or the club's representative to ensure that the club's bank details are entered correctly on their dashboard. Please note what happens in the event of incorrect bank details being provided in clause 6 below.
  • Affiliated cricket clubs can register their participation to become Beneficiaries at any time during the Entry Period.
  • By a representative of a club registering their club to become a Beneficiary, that representative acknowledges and agrees (on behalf of themselves and their club) to be bound by these T&Cs.

5. How to Fundraise

  • Once the cricket club has been registered, its representative will be directed to their club's own dashboard where they will receive a URL which is unique to their club and which can be included on their club's marketing and fundraising material.
  • To support a cricket club of their choosing, entrants to the Prize Draw can either:
    • Use the cricket club's specific URL to purchase tickets. All tickets purchased using the URL will automatically be linked to the specific club and that club will receive all of the funds raised from such purchase; or
    • Visit the main URL for the website homepage and ensure that they select their chosen cricket club during the ticket purchase process.
    • Entrants to the Prize Draw can also choose for their support to go into a central pot ["Central Fund"], which will be distributed evenly amongst eligible participating Beneficiaries.

6. Bank Account Ownership

  • Any bank account registered on the Platform for the purpose of receiving funds generated from tickets sold in the Prize Draw must be in the name of the cricket club.
  • Bank accounts in the name of individual persons will not be accepted and will result in disqualification.
  • A third party instructed by the Promoter will perform checks to validate the club's bank details. If the bank account is not in the name of the club or bank details have been entered incorrectly, the Promoter will endeavour to contact the club, but if verification of the bank details has not been completed or the correct bank details have not been received by the time the Central Fund is distributed, the funds raised relating to that club through the Prize Draw will instead be transferred into a Central Fund to be distributed equally amongst all eligible participating Beneficiaries.

7. The Funds

  • When entrants purchase tickets and a club's unique URL is not used, they can specify which club will receive the funds from their ticket purchase or specify that the funds from their ticket purchase should be transferred into the Central Fund. If a club is selected, that club will receive 100% of the funds from that ticket purchase. If the Central Fund is selected, the funds will be distributed equally amongst all eligible participating Beneficiaries.
  • Any interest or other financial gains accruing on funds raised by the Clubs shall not be retained by the Clubs. All such interest shall be allocated at the Promoter's sole discretion either (i) to the Central Fund, or (ii) to a recognised community cricket charity selected by the Promoter. For the avoidance of doubt, Clubs shall have no entitlement to any interest earned on funds raised
  • For any Beneficiaries that have raised over £8,000, the Promoter reserves the right to contact the club or a representative to verbally verify the bank details that have been provided. The funds will not be distributed until verbal verification has taken place. The funds will not be subject to the same non-verification consequences as mentioned in clause 6. The Promoter will hold onto the funds until verification has taken place.
  • With the above clause, if verbal verification of the club's bank details has not been achieved within 6 months of the Prize Draw closing, the funds raised will be donated to a charity working in community sport, of the Promoter's choice.
  • For any club that has raised funds but fails the validation checks on their bank details or is otherwise disqualified from being a Beneficiary, the funds raised relating to that club through the Prize Draw will be transferred to the Central Fund and will be distributed equally amongst all eligible participating Beneficiaries.
  • If there are any funds remaining ("Remaining Funds") in the Central Fund after the funds in the Central Fund have been distributed amongst all eligible participating Beneficiaries - because it is not mathematically possible to distribute the Remaining Funds equally amongst all eligible participating Beneficiaries - the Promoter shall donate such Remaining Funds to a charity working in community sport, of its choice.
  • We will endeavour to distribute all funds within 60 days of the Prize Draw closing, but in the event of issues outside of the Promoter's control, the Promoter will not be held liable.
  • All funds received by cricket clubs from the Prize Draw shall be used for activities that develop and enhance the cricket club. This includes, but is not limited to, the purchase of equipment, facility improvements, coaching and training programs, organizing and participating in matches and tournaments, and any other initiatives that contribute to the growth and betterment of the club.

8. Disqualification Criteria

  • Clubs will be disqualified from being a Beneficiary if:
  • They are unaffiliated at the time they register to become a Beneficiary;
  • Clubs are affiliated at the time of registration to become a Beneficiary but become unaffiliated at any time during the Prize Draw;
  • An entry is submitted using a bank account that is not in the name of the club;
  • If at any point the club's bank details cannot be verified; and/or
  • Any false or misleading information is provided during the entry process or at any other time.
  • Clubs are found to be behaving in a way that goes against the spirit of the Prize Draw; and/or They are suspended or are the subject of an ongoing investigation under the Board's Code of Conduct. In such circumstances, the Promoter shall have sole discretion to determine whether any funds raised by the club are transferred into the Central Fund or held in suspense until the investigation is concluded.

9. Verification and Compliance

  • The Prize Draw is administered by Gatherwell Limited on behalf of Toyota (GB) PLC. The organisers reserve the right to verify a club's affiliation status and bank account ownership at any time.
  • Gatherwell Limited and Toyota (GB) PLC also reserve the right to refuse or withdraw a club's eligibility if any of these T&Cs are breached.

10. Governing Law

These T&Cs shall be governed by and interpreted in accordance with the laws of England and Wales, and any disputes arising out of or in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
